New OSHA Resource: Recommended Practices for Anti-Retaliation Programs

The topic of broad stroke drug and alcohol testing of injured workers and possible OSHA enforcement activity is currently surrounded by much discussion and even more confusion. OSHA recently issued a new publication, titled “Recommended Practices for Anti-Retaliation Programs” and assigned it as “OSHA3905”, which is OSHA’s effort in assisting employers in “creating workplaces free of retaliation”.   This document is available here:

The document contains a broad description of a 5 point plan. I chose the word “broad” because that’s exactly what it is, with very little detail. However, it does work well as a starting point for internal discussions that management teams need to have.
